Congress: The House and Senate were on recess this past week, and will reconvene on Tuesday and Monday, respectively.

FY 2026 Appropriations: In contrast to prior reports, a Republican-only reconciliation bill to fund immigration enforcement agencies is expected to be narrow in scope and therefore will likely not include the party's broader priorities on healthcare.

Legislation: Bipartisan legislation to prohibit providers from denying organ transplants to patients solely based on a disability, has been removed from near-term consideration by the Senate Health, Education, Labor & Pensions (HELP) Committee. This in large part due to concerns over how HHS may manage discrimination claims. Companion legislation has already passed the House.

The FY 2027 HHS budget proposal re-emphasizes Administration NIH funding goals. It again proposes to cap indirect costs at 15%. This is despite the Administration missing a deadline last week for the Supreme Court to reconsider lower court decisions preventing the original rate cuts from being implemented. Moreover, the agency proposes to fund all grants in full upfront in FY 2027, continuing the agency’s transition to multi-year awards:

The agency is soliciting feedback on its FY 2027- FY 2031 Strategic Plan. The deadline to submit comments is May 26.

The agency has sent guidance to states on compliance with measures in the One Big Beautiful Bill Act limiting non-citizen enrollment in Medicaid.

The agency intends to implement a portal this summer for seniors to access medical records online using biometrics.

A 2.4% increase in CMS payment rates to hospitals have been outlined in a proposed rule.

FDA: The agency’s FY 2027 budget justification proposes measures allowing drugmakers commence clinical trials earlier and US generics manufacturers to challenge drugs patents sooner.

CDC: HHS has published new rules that expand Secretary Kennedy’s authority to appoint members of the Advisory Committee on Immunization Practices (ACIP). The rules broaden criteria for ACIP membership beyond individuals with vaccine and immunology expertise. This was done in response to court rulings that set back the Secretary's previous efforts to add vaccine skeptics to the panel. Despite this change, the Secretary and Administration are concertedly attenuating their rhetoric on vaccines.

DoD: The agency has announced policy changes prohibiting collaboration on federally funded projects with organizations included on the ‘restricted entity list’ - with an intended focus on Chinese groups.

HHS Restructuring and RIFs: A federal court will advance a lawsuit filed by 19 states against the Administration and Secretary Kennedy’s attempts to significantly downsize and reorganize the department.

Tariffs & Trade Deals: The US and Switzerland are expected to come to a trade agreement this summer, with measures to address tariffs impacting imports of Swiss drugs.
