Updates from Washington

Congress: 
  • The House conducted very limited legislative business aside from passing the continuing resolution (CR) to fund the government through December 11. The chamber will reconvene this coming week, but will be on recess for the remainder of the month, and will not be back in session until after the election. The Senate will return on September 14.
  • Rep. Diana DeGette (D-CO), the outgoing Ranking Member one the Energy & Commerce Committee’s Health Subcommittee, introduced a bill to cap insulin costs at $35 a month. The legislation is bipartisan with two Republicans joining as original co-sponsors. It is similar, but not a direct companion to the Senate’s INSULIN Act that has the same goal, and passed the Health Education Labor & Pensions (HELP) Committee in July.
Administration & Agencies:
  • NIH: The agency has entered into a ten-year agreement, not previously disclosed to Congress, that could move billions of dollars of funding at the National Institute of Allergy and Infectious Disease (NIAID) for infectious disease research to the Pentagon. Agency executives pushed back against allegations that NIH funds were being cut, describing the move as one intended to ease interagency coordination in responding to emerging chemical, biological, radiological and nuclear (CBRN) threats, including in the development of medical countermeasures.
  • FDA: The agency has announced that it will increase its resources directed to oversight of clinical trials with foreign sites, to address concerns surrounding potential deviations from Good Clinical Practice and the quality of data being generated abroad.
  • CDC
    • HHS Secretary Kennedy has asked CDC Director Erica Schwartz to remove two deaths in Pennsylvania that state officials affirmed are linked to measles, from the national tally. This comes a week after Kennedy was involved in a public spat with Governor Josh Shapiro on the issue.
    • The American Medical Association and other provider associations have developed and begun issuing their own immunization recommendations, in response to recent Administration pronouncements remaking the childhood vaccination schedule. The provider recommendations align with CDC on flu and RSV vaccines, but contrast with the Administration on COVID-19, urging that among others, all infants aged 6-23 months receive the shot.
  • White House, Other HHS Agencies & Departments:
    • Drug Pricing: As expected, on Monday the White House announced pricing deals with nine pharmaceutical and biotechnology companies. The announcement indicates that 89% of the branded drug market is now subject to the Administration’s most favored nation (MFN) pricing agreements. Details of these latest individual agreements remain private, and any benefits the companies receive such as exemption from tariffs or from participation in certain Medicare pilots have not been disclosed, unlike prior announcements. The companies are required to:
      • Provide every state Medicaid programs with access to MFN drug prices on certain products
      • Invest collectively $19.6 billion, on U.S. manufacturing
      • Contribute tons of essential active pharmaceutical ingredients (APIs) to the Strategic API Reserve (four of the nine companies)
    • CR: President Trump signed the CR Wednesday, the day after it was passed by the House.
